Video FAQ:

Are there any time limits on filing a lawsuit for repairs in a construction defect case?

Yes, there are two time limits that people have to be very aware of. One of them is the 10 year statute of limitations, and one of them is the 4 year statute of limitations. The 10 year statute runs from the date the billings were completed, and if a claim isn’t brought within that 10 year period, the entire claim is wiped out. The 4 year statute runs on a defect by defect basis, and it begins to run when you’re either aware of a defect or you should be aware of the defect with the exercise of reasonable diligence.
