Is the association or the homeowner responsible for pursuing construction defect claims?

Whether the homeowner’s association or the individual homeowner’s responsible for pursing a construction defect claim depends upon what component it is that has the problem. If it’s a component or which the homeowner’s association is responsible then it’s the homeowner’s association’s responsibility to pursue the construction defect claim. If it’s an individual item, such as something inside your home, then it’s the individual homeowner’s responsibility.
