What is Chapter 558 and how does it work?

Chapter 558 is the Construction Defect Statute in Florida. The primary purpose of Chapter 558 is to establish a pre-litigation procedure so that builders receive notice of defects and have an opportunity to conduct an inspection and propose some kind of resolution. The resolution can be either performing repairs, or it can be paying money so the association can perform those repairs with their own contractors.

One of the key features of Chapter 558 is that there is a fairly strict timeline within which the builder and/or the subcontractors must participate. Basically, they have 50 days to come out and do an inspection and 75 days to make a written proposal for settlement.
