What is the statute of limitations for bringing a construction defect claim?

There are two primary statutes of limitation for bringing a construction defect claim. The outside time within which a claim must be brought is 10 years from the date the construction is completed. There are some nuances to that, but that’s a general rule, from the day construction is completed. There’s also a shorter statute of limitations of 4 years. The 4 year statute of limitations runs from when the association is either aware or should be aware with the exercise of due diligence that a construction defect exists.
