Who decides the transition date?
The transition date is determined primarily by the sales of the units in the project. Once 90% of the units have been sold the transition process starts. There’s a 90 day waiting period after which the home owners are entitled to elect the entire board. In a condominium association, the developer has 75 days in which to conduct that election. It takes 60 days at a minimum. In a home owner’s association the developer has 90 days to complete that process, and the process is determined by the language and the by-laws.
